Terms of Service

These terms govern your use of the Piha Tank Watch website and app. By creating an account or using the service, you agree to them. Please also read our Privacy Policy.
1. What the service is
Piha Tank Watch shows the water level in your rainwater tank using a sensor and our app, and can send alerts (e.g. when your level is low). It’s a monitoring aid.
2. Your account
You sign in with your email address and a one-time code (no password). Keep access to your email secure — anyone who can receive your codes can access your account. You’re responsible for activity under your account, and for who you choose to share a tank with or link as an installer.
3. Hardware & installation
Sensor hardware may be purchased and installed by a trade partner/installer, or self-installed (DIY). We are not responsible for hardware you source elsewhere or for installation work performed by you or a third party. Correct installation affects accuracy.
4. Plans & billing
- Some features require a paid plan. Prices are shown in New Zealand dollars (NZD) on our pricing page.
- Payments are processed by Stripe; we don’t handle your card details.
- Paid plans renew automatically each billing period until cancelled.
- You can cancel or downgrade in the app; the change takes effect at the end of your current paid period, and we don’t provide refunds for partial periods unless required by law.
- We may change plan features or prices; we’ll give reasonable notice of price changes, which take effect at your next renewal.
5. Acceptable use
Don’t misuse the service: no unlawful use, no attempting to break, overload, or gain unauthorised access to the service or others’ data, and no using it to infringe others’ rights.
6. Availability
We aim to keep the service available and reliable, but we don’t guarantee uninterrupted or error-free operation. We may perform maintenance, and features may change over time.
7. Liability
If you use the service as a consumer, nothing in these terms limits rights you have under the Consumer Guarantees Act 1993 or other rights that can’t legally be excluded. Subject to that, and to the maximum extent permitted by law: the service is provided “as is”; we’re not liable for indirect or consequential loss, or for loss arising from reliance on readings, estimates or alerts, or from water running out. Where the Consumer Guarantees Act doesn’t apply (e.g. you acquire the service for a business), you agree those guarantees are excluded.
8. Termination
You can stop using the service and delete your account at any time in the app. We may suspend or end access if these terms are breached or where necessary to protect the service or others.
9. Governing law
These terms are governed by the laws of New Zealand, and the New Zealand courts have jurisdiction.
10. Changes
We may update these terms; we’ll post the new version here with an updated date and, for significant changes, highlight them.
